An immigration evaluation is a psychosocial assessment with the purpose of determining and explaining how/if the United States Citizen or Lawful Permanent Resident would suffer hardship if a family member was deported or not allowed to enter the country, as well as if the client had to leave the U.S.A to live with family member in their country of origin. Hardship evaluations compliments application. 

As a qualified mental health professional, I can help explain to the immigration professionals what the psychological and emotional impact of separation in families may be based on information from interviews and tests.

Offering psychosocial evaluations for immigration cases for the following situations:

  1. Extreme hardship waiver (I-601 AND I-601A) - Evaluation for this waiver is often given to the spouse, child or parent of the non-citizen.

  2. Cancellation of Removal- Given to someone who has lived in the U.S for more than 10 years but are in removal proceedings.

  3. VAWA/Domestic Violence Evaluations - Used in spousal abuse cases when an individual from a foreign country marries a United States Citizen or Lawful Permanent Resident and the relationship becomes abusive, with the United States Citizen as abuser. 

  4. U-Visa- Used for those that have been a victim of a serious crime and are cooperating with law enforcement officials in the prosecution of the perpetrators.

  5. T-Visa- Used for victims of human trafficking into the U.S and are cooperating with law enforcement officials in the prosecution of the perpetrators. 

  6. Political Asylum- For those that have been exposed to extreme deprivation, severe abuse, and even torture in their home country.

Process:

 

The evaluation process normally consists of 2 90-minute interview sessions. These sessions take place through a secure, HIPAA compliant and online portal so you can be in the comfort of your home. Interviews will cover personal and family history, family life, health and other factors in your life. The process will also include screening tools and/or tests. Draft will be sent to you, time permitting, and then your attorney for review. Once approved, a final and signed report will be mailed to you and your attorney. The process usually takes 3-4 weeks.

Fees:

 

 Evaluation is $1000 which includes records review, consultation with lawyer, clinical interviews, testing measures, report writing and postage fees. Full payment must be received before final copies are mailed out. Payment plans and sliding scale available, if needed.

Expedited report fee: If an evaluation and report is needed in less than 2 weeks, an expedite report cost will be added. Please contact me to learn more about this.

Court fee: If I am required to be in court, the time preparing, traveling to and attending court will have an additional hourly fee with a mandatory deposit of 4 hours of time that will be required prior to going to court. This is non-refundable. Please contact me to learn more about this fee.
